OK so Gutshot is still open for business, but with shorter opening times and it seems games are on a more ad-hoc basis; though there are no charges for playing. Before sentencing Judge Wilkinson noted the following:
That Derek Kelly is a man of good character, a genuine poker enthusiast and expressed himself with candour at all times.
He also conceded that Gutshot is well managed and responsible for catering in what appeared to be a properly structured way for all levels of poker play.
With that consideration he delivered the following sentence:
• A conditional discharge for two years, the condition being that Derek Kelly will not contravene the Gaming Act in that period
• No fine
• A payment of £10k towards prosecution costs (thought to be in the region of £25k) - this to be paid in monthly instalments of £500 |
