OK so Gutshot is still open for business, but with shorter opening times and it seems games are on a more ad-hoc basis; though there are no charges for playing. Derek Kelly has also resigned as chairman of the Club (presumably to avoid damaging it and to prepare his appeal case..)

Before sentencing Judge Wilkinson noted the following:

That Derek Kelly is a man of good character, a genuine poker enthusiast and expressed himself with candour at all times.

He also conceded that Gutshot is well managed and responsible for catering in what appeared to be a properly structured way for all levels of poker play.

With that consideration he delivered the following sentence:
• A conditional discharge for two years, the condition being that Derek Kelly will not contravene the Gaming Act in that period
• No fine
• A payment of £10k towards prosecution costs (thought to be in the region of £25k) - this to be paid in monthly instalments of £500
